Local Government Elections

The Local Government  Act 1999 (LG Act) has undergone legislative reform including changes to the use of election signage.
Section 226(2a) of the LG Act prohibits exhibiting an electoral advertising poster made of corflute or plastic, in relation to an election held under the LG Act or the Local Government (Elections) Act 1999, on any structure, fixture, or vegetation on a public road, except as prescribed by the Regulations.

Public road is defined in the LG Act and includes the area between a kerb and a property boundary, such as a footpath.
Consequently, corflute election signs cannot be affixed to stobie poles, traffic signs, trees, etc. along a public road.

The maximum penalty is a $5,000 fine.

Wattle Range Council has given a General Approval for the placement of local government election signs (not being electoral advertising posters made of corflute or plastic). The placement of election signs must be in accordance with the conditions specified in this General Approval, or if placed on infrastructure owned by SA Power Networks or the Department for Infrastructure and Transport, be in accordance with the conditions specified in their respective general approvals.
